Ex-Premier League star wins landmark overseas property case

A former Premier League footballer has secured a significant legal victory in a long-running overseas property dispute that highlights the risks facing UK buyers investing abroad.

Neil Heaney (main picture, inset), who played for clubs including Arsenal and Manchester City, founded international law firm Judicare Law International after personally falling victim to a property scam earlier in his career.
The firm has now successfully pursued a Spanish bank through multiple court stages, culminating in a win at the Spanish Supreme Court, to recover a client’s lost property investment.

The case centred on a failed overseas development where a UK buyer paid a substantial deposit to a developer that later went bankrupt, leaving the property unbuilt. With no developer to pursue, Judicare instead targeted the bank involved in the transaction, arguing it should be liable as guarantor under Spanish law.

FINAL RULING

The firm won at first instance and on appeal, before the bank escalated the case to the highest court in Spain – where Judicare has now secured a final ruling in its client’s favour.

The outcome highlights the legal complexities facing UK investors purchasing property overseas, particularly where different jurisdictions, languages and regulatory frameworks are involved. It also raises broader questions for agents and brokers operating in the international property market, where due diligence and legal oversight remain critical.

Cross-border property transactions have become increasingly common, driven by lifestyle buyers, second-home investors and internationally mobile clients. However, cases such as this highlight the potential exposure when developments fail or protections are unclear.
